These Terms of Use and Sale ("Terms") govern your access to and use of the FOODNUTRA website, mobile applications (if any), products and services offered through www.foodnutra.com ("website").
The website is owned and operated by EXTANT FOOD PRIVATE LIMITED, a company incorporated under the Companies Act, 2013, bearing CIN: U15490UP2021PTC142750, having its registered office at 1712-A, Tower-3, NX ONE, Tech Zone-4, Greater Noida (West), Gautam Buddha Nagar, Uttar Pradesh – 201306 (hereinafter referred to as "FOODNUTRA", "Company", "we", "our", or "us").
By accessing, browsing, registering on, or placing an order through this website, you acknowledge that you have read, understood and agreed to be legally bound by these Terms, our Privacy Policy, Return & Refund Policy, Shipping Policy and all other policies published on the website. If you do not agree with any part of these Terms, you should immediately discontinue using the website.
These Terms constitute a legally binding agreement between you ("User", "Customer", "you", or "your") and FOODNUTRA.
1. Acceptance of Terms
1.1 By visiting, browsing, creating an account, purchasing products, or otherwise using the website, you expressly agree to comply with these Terms and all applicable laws and regulations.
1.2 These Terms apply to every visitor, registered customer, corporate buyer, reseller and any person accessing the website, regardless of the device used.
1.3 FOODNUTRA reserves the right to amend, modify, replace, or update these Terms at any time without prior notice. Updated Terms shall become effective immediately upon publication on the website. Continued use of the website after such updates constitutes your acceptance of the revised Terms.
1.4 You are responsible for reviewing these Terms periodically to remain informed of any changes.
2. Eligibility
2.1 To use this website or place an order, you must:

possess the legal capacity to enter into a binding contract under applicable Indian laws; and
provide accurate and complete information whenever requested.

2.3 FOODNUTRA reserves the right to refuse service, suspend accounts, or cancel orders if it believes that a user has provided false information or does not meet the eligibility requirements.
3. User Registration and Account

3.2 When registering, you agree to provide information that is accurate, current and complete and to promptly update such information whenever necessary.
3.3 You are solely responsible for maintaining the confidentiality of your login credentials, password and account information.
3.4 Any activity conducted through your account shall be deemed to have been performed by you. FOODNUTRA shall not be responsible for any loss or damage resulting from unauthorised use of your account arising from your failure to protect your credentials.
3.5 You agree to immediately notify FOODNUTRA of any suspected unauthorised access or security breach involving your account.
3.6 FOODNUTRA reserves the right to suspend, restrict, or permanently terminate any account that is found to be involved in fraudulent activities, misuse of promotional offers, abuse of customer support, or violation of these Terms.
4. Products and Product Information
4.1 FOODNUTRA offers a wide range of food products, including but not limited to dry fruits, nuts, seeds, spices, herbs, healthy snacks, flavoured products, processed and non-processed food items, superfoods, trail mixes, gift packs and other food products that may be introduced from time to time.
4.2 Every effort is made to ensure that product descriptions, images, nutritional information, ingredients, packaging details, prices and specifications displayed on the website are accurate. However, minor variations may occur due to product improvements, supplier changes, seasonal availability, photography, screen settings, or printing differences.
4.3 Images displayed on the website are for illustrative purposes only. Actual products, packaging, colours, sizes and labelling may differ slightly from those shown.
4.4 Since many of our products are natural agricultural products, variations in colour, texture, size, flavour, aroma, moisture content, or appearance may naturally occur between batches. Such variations do not constitute manufacturing defects or quality issues.
4.5 Product availability displayed on the website is indicative and subject to stock availability at the time of order processing.
4.6 FOODNUTRA reserves the right to discontinue, modify, substitute, limit, or withdraw any product without prior notice.
5. Food Safety and Consumer Responsibility
5.1 Customers are encouraged to carefully read product descriptions, ingredient lists, allergen information, nutritional facts, storage instructions and usage recommendations before purchasing or consuming any product.
5.2 Certain products may be processed, packed, or stored in facilities where allergens such as peanuts, tree nuts, milk, soy, sesame, wheat, gluten, or other ingredients are also handled. Customers with known allergies should exercise appropriate caution before consumption.
5.3 Information published on the website is intended solely for general informational purposes and should not be interpreted as medical, nutritional, dietary, or healthcare advice.
5.4 Customers with medical conditions, food allergies, pregnancy-related dietary restrictions, or other health concerns should consult a qualified healthcare professional before consuming any product purchased from FOODNUTRA.
6. Pricing
6.1 Unless otherwise specified, all prices displayed on the website are in Indian Rupees (INR).
6.2 Prices may include or exclude applicable taxes depending upon the product listing and applicable legal requirements. Final pricing, including taxes, shipping charges, discounts and promotional benefits, will be displayed during checkout before payment confirmation.
6.3 FOODNUTRA reserves the right to revise product prices at any time without prior notice.
6.4 In the event of an obvious pricing error, typographical mistake, technical malfunction, or system error resulting in an incorrect price being displayed, FOODNUTRA reserves the right to cancel or refuse such order, even if payment has already been received. In such cases, any amount collected shall be refunded to the original payment method.
6.5 Promotional prices, festive offers, coupon discounts, cashback offers and limited-time deals remain valid only during their specified validity period and may be withdrawn without prior notice.
7. Orders and Acceptance
7.1 Placing an order on the website constitutes an offer by you to purchase the selected products. Submission of an order does not automatically result in acceptance by FOODNUTRA.
7.2 An order shall be deemed accepted only after FOODNUTRA has verified payment (where applicable), confirmed product availability, completed internal fraud prevention checks and initiated order processing.
7.3 FOODNUTRA reserves the absolute right to refuse, limit, or cancel any order, including but not limited to situations involving:
suspected fraud or unauthorized transactions;
inaccurate customer information;
pricing or technical errors;
unusual order quantities;
stock unavailability;
violations of these Terms; or
circumstances beyond the Company's reasonable control.
7.4 In the event an order is cancelled after payment has been successfully received, the eligible refund shall be processed in accordance with the Company's Refund Policy.
7.5 FOODNUTRA reserves the right to impose quantity restrictions on selected products to ensure fair availability to all customers.
8. Payment Terms
8.1 FOODNUTRA accepts payments through various secure payment methods, including but not limited to:

Debit Cards
Net Banking
Digital Wallets
Cash on Delivery (where available)
Any other payment method introduced from time to time.
8.2 All online payments are processed through secure third-party payment gateways. FOODNUTRA does not store complete credit card, debit card, or banking credentials on its servers.
8.3 Your payment transaction is subject to approval by your issuing bank, payment network, or payment service provider. FOODNUTRA shall not be responsible for payment failures, processing delays, banking errors, or technical interruptions occurring outside its control.
8.4 Cash on Delivery services, where available, may be restricted based on delivery location, order value, customer purchase history, or internal risk assessment.
8.5 FOODNUTRA reserves the right to suspend Cash on Delivery facilities for any customer or geographic location without prior notice.
8.6 Any attempt to obtain products through fraudulent payment methods, chargeback abuse, stolen payment instruments, or unauthorized transactions may result in cancellation of orders, suspension of user accounts and appropriate legal action.
9. Shipping and Delivery
9.1 FOODNUTRA delivers products across eligible locations in India through trusted logistics and courier partners. Delivery availability may vary based on the customer's location and serviceability.
9.2 Estimated delivery timelines displayed on the website are indicative only and should not be construed as guaranteed delivery dates. Actual delivery may vary due to factors including courier operations, weather conditions, public holidays, regulatory restrictions, natural disasters, transportation disruptions, or other circumstances beyond our reasonable control.
9.3 Customers are responsible for providing accurate and complete delivery details, including the recipient's name, address, landmark, PIN code, mobile number and any other information required for successful delivery.
9.4 FOODNUTRA shall not be responsible for delays, failed deliveries, or additional charges arising from incorrect or incomplete shipping information provided by the customer.
9.5 Risk and ownership of the products shall pass to the customer upon successful delivery to the shipping address provided at the time of placing the order.
9.6 If a delivery attempt fails due to customer unavailability, refusal to accept the shipment, incorrect address, or any other customer-related reason, FOODNUTRA reserves the right to cancel the order or charge additional shipping costs for re-delivery.
9.7 Customers are advised to inspect the package at the time of delivery. If the outer packaging appears tampered with, damaged, or opened, customers should refuse delivery or record appropriate evidence before accepting the package and immediately contact our customer support team.
10. Order Cancellation
10.1 Customers may request cancellation of an order only before the order has been packed, dispatched, or handed over to the logistics partner.
10.2 Cancellation requests may be submitted through the customer account, by contacting our customer support team, or by emailing support@foodnutra.com.
10.3 Once an order has been dispatched, it cannot ordinarily be cancelled. Customers may instead refer to our Return and Refund Policy, where applicable.
10.4 FOODNUTRA reserves the right to cancel any order at its sole discretion, including but not limited to the following circumstances:
Product is unavailable or out of stock;
Pricing or technical errors;
Payment verification failure;
Suspected fraudulent or unauthorized transactions;
Violation of these Terms;
Regulatory restrictions; or
Any event beyond the reasonable control of FOODNUTRA.
10.5 Where an order is cancelled by FOODNUTRA after payment has been successfully received, the eligible refund shall be processed through the original payment method within a reasonable period, subject to banking and payment gateway timelines.
11. Return, Refund and Replacement Policy
11.1 Due to the perishable and consumable nature of food products, returns shall only be accepted in circumstances specifically approved by FOODNUTRA.
11.2 Customers must report any issue relating to damaged, defective, expired, incorrect, missing, or contaminated products within 48 hours of delivery by contacting our customer support team along with clear photographs of the product, packaging, invoice and shipping label.
11.3 FOODNUTRA reserves the right to inspect the complaint and request additional information before approving any return, replacement, or refund.
11.4 Refunds or replacements may be approved where:
the wrong product has been delivered;
the product is received in a damaged condition;
the product is expired at the time of delivery;
the product is defective due to manufacturing issues; or
any other issue is verified by FOODNUTRA.
11.5 Refunds or replacements shall generally not be provided in the following situations:
dissatisfaction relating to taste, flavour, aroma, texture, or personal preference;
minor natural variations in colour, size, or appearance;
improper storage after delivery;
damage caused by customer handling;
requests made after the prescribed reporting period;
products without original packaging or proof of purchase.
11.6 Approved refunds shall be processed through the original payment method wherever feasible. Refund processing timelines may vary depending upon the payment provider and banking institutions.
11.7 Cash on Delivery orders, where eligible for refund, may be refunded through bank transfer, UPI, or any other method approved by FOODNUTRA.
12. Product Quality and Natural Variations
12.1 FOODNUTRA is committed to sourcing, processing, packaging and delivering quality food products while maintaining applicable food safety standards.
12.2 Since many of our products are agricultural and naturally sourced, customers acknowledge that variations in colour, size, texture, moisture, flavour, aroma and appearance may occur due to seasonal conditions, harvesting methods, crop origin, climate, storage conditions, or natural processing methods.
12.3 Such natural variations shall not constitute defects, quality issues, or grounds for return or refund.
12.4 Product packaging may change periodically without prior notice as part of branding improvements or regulatory compliance.
12.5 Product weights may vary slightly within the tolerance limits permitted under applicable laws and industry practices.
13. Food Allergy and Health Disclaimer
13.1 Certain FOODNUTRA products may contain or be processed in facilities that also handle peanuts, tree nuts, milk, soy, sesame, wheat, gluten, spices, seeds, or other allergens.
13.2 Customers with known food allergies, dietary restrictions, or medical conditions are advised to carefully review product labels and ingredient information before consumption.
13.3 The nutritional information, health benefits, product descriptions and consumption suggestions available on the website are provided for general informational purposes only.
13.4 FOODNUTRA does not provide medical advice and does not guarantee that any product will prevent, diagnose, treat, cure, or alleviate any disease or health condition.
13.5 Customers should consult a qualified healthcare professional before consuming products if they are pregnant, breastfeeding, undergoing medical treatment, following a special diet, or suffering from any medical condition.
13.6 FOODNUTRA shall not be liable for allergic reactions, adverse health effects, or medical complications arising from undisclosed allergies, improper consumption, or failure to follow product instructions.
14. Promotional Offers, Discounts and Coupons
14.1 FOODNUTRA may periodically introduce promotional campaigns, referral programs, cashback offers, discount coupons, gift vouchers, loyalty rewards, or other marketing initiatives.
14.2 Unless expressly stated otherwise, promotional offers:
cannot be exchanged for cash;
cannot be transferred;
cannot be combined with other promotions;
are valid only during the specified promotional period; and
may be withdrawn or modified at any time without prior notice.
14.3 FOODNUTRA reserves the right to reject any coupon, promotional code, or reward that has been obtained through fraudulent, automated, abusive, or unauthorized means.
14.4 Any misuse of promotional offers, including creation of multiple fake accounts, referral abuse, bulk purchases intended to exploit discounts, or manipulation of promotional systems, may result in cancellation of orders, forfeiture of benefits, suspension of user accounts and legal action where appropriate.
15. Customer Responsibilities
15.1 Customers agree to use the website honestly, responsibly and in compliance with all applicable laws.
15.2 Customers are responsible for ensuring that all information provided during registration and checkout remains accurate and up to date.

16.2 FOODNUTRA™, its logo, branding elements, product names, taglines and all associated intellectual property are the exclusive property of the Company unless otherwise stated.
16.3 You are granted a limited, non-exclusive, non-transferable and revocable licence to access and use the website solely for personal, lawful and non-commercial purposes.
16.4 You shall not copy, reproduce, modify, distribute, transmit, display, reverse engineer, sell, license, or commercially exploit any part of the website or its Content without the Company's prior written consent.
16.5 Any unauthorized use of the Company's intellectual property may result in civil and criminal proceedings under applicable laws.
17. User Reviews and Feedback
17.1 Customers may submit reviews, ratings, comments, suggestions, photographs, or other content relating to products or services, provided such content is truthful, lawful, respectful and based on genuine experience.
17.2 By submitting any review or feedback, you grant FOODNUTRA a perpetual, worldwide, royalty-free, irrevocable, transferable and non-exclusive licence to use, reproduce, modify, publish, translate, display, distribute and promote such content for marketing, business, or operational purposes without additional compensation.
17.3 You confirm that your submissions:
are accurate and based on your genuine experience;
do not violate any applicable law;
do not infringe any third-party rights;
are not defamatory, abusive, obscene, misleading, discriminatory, or offensive.
17.4 FOODNUTRA reserves the right to edit, refuse, remove, or moderate any user-generated content that violates these Terms or may adversely affect the Company's reputation or other users.

18.4 Your interactions with third-party providers are solely between you and the respective provider.
19. Limitation of Liability
19.1 To the fullest extent permitted by applicable law, FOODNUTRA, its directors, officers, employees, affiliates, licensors, suppliers and business partners shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the use of the website or products purchased through it.
19.2 FOODNUTRA shall not be liable for any loss arising from:
delays in delivery caused by logistics partners or events beyond our reasonable control;
customer-provided incorrect delivery information;

internet or network failures;

19.3 In any event, the Company's total liability relating to a particular order shall not exceed the amount actually paid by the customer for that order.

violation of applicable laws;

fraudulent or negligent acts committed by you.

24.2 During the continuance of such events, FOODNUTRA's obligations shall remain suspended to the extent affected.
25. Governing Law and Dispute Resolution
25.1 These Terms shall be governed by and interpreted in accordance with the laws of India.
25.2 The parties shall endeavour to resolve any dispute arising out of or relating to these Terms through good-faith negotiations.
25.3 If a dispute cannot be resolved amicably within thirty (30) days, it shall be referred to a sole arbitrator appointed by FOODNUTRA in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
25.4 The arbitration proceedings shall be conducted in English.
25.5 The seat and venue of arbitration shall be Gautam Buddha Nagar, Uttar Pradesh, unless otherwise agreed by the parties.
26. Jurisdiction
Subject to Clause 25 relating to arbitration, the courts having jurisdiction in Gautam Buddha Nagar, Uttar Pradesh, shall have exclusive jurisdiction over all matters arising out of or relating to these Terms, the website, or any transaction conducted through the website.
27. Amendments
FOODNUTRA reserves the right to modify, amend, update, or replace these Terms at any time. Revised Terms shall become effective immediately upon publication on the website unless otherwise specified. Continued use of the website after such publication shall constitute acceptance of the revised Terms.
28. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.
29. Waiver
Failure by FOODNUTRA to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights available to the Company.
30. Entire Agreement
These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy and any other policies published on the website, constitute the complete agreement between you and FOODNUTRA regarding your use of the website and purchase of products, superseding all prior communications, understandings, or agreements relating to the same subject matter.
